Is Palin violating the LOGAN ACT LAW?

In United States v. Curtiss-Wright Export Corp. (1936), however, Justice Sutherland wrote in the majority opinion: "[T]he President alone has the power to speak or listen as a representative of the nation. He makes treaties with the advice and consent of the Senate; but he alone negotiates. Into the field of negotiation the Senate cannot intrude, and Congress itself is powerless to invade it." Sutherland also notes in his opinion the Senate Committee on Foreign Relations report to the Senate of February 15, 1816:

The President is the constitutional representative of the United States with regard to foreign nations. He manages our concerns with foreign nations, and must necessarily be most competent to determine when, how, and upon what subjects negotiation may be urged with the greatest prospect of success. For his conduct, he is responsible to the Constitution.[6]

§ 953. Private correspondence with foreign governments.

Any citizen of the United States, wherever he may be, who, without authority of the United States, directly or indirectly commences or carries on any correspondence or intercourse with any foreign government or any officer or agent thereof, with intent to influence the measures or conduct of any foreign government or of any officer or agent thereof, in relation to any disputes or controversies with the United States, or to defeat the measures of the United States, shall be fined under this title or imprisoned not more than three years, or both.

This section shall not abridge the right of a citizen to apply himself, or his agent, to any foreign government, or the agents thereof, for redress of any injury which he may have sustained from such government or any of its agents or subjects.

While speaking in India, Sarah Palin suggested that China was becoming a threat to the United States.  She went so far as to say that China is preparing itself to launch a military offensive.  “What’s with the military buildup?”  Questioning the “stockpiling of ballistic missiles, submarines and new-age ultra modern aircraft,” Sarah Palin felt that the enhanced military strength of China was “unjustified.” Pouring salt in the wound, she shared his astute observation that  “China’s military growth can’t just be for defensive purposes.”  If that were true, the United States would certainly be planning an assault on the entire world.

Note: We just got back from taking our Granddaughter camping for a week during her spring break.  Finding that Palin is in India and Israel babbling like a brook that speaks for the US is very unsettling so I was very curious about the Logan Act Law and if I am the only one who thinks she is breaking the law and should be prosecuted, especially during a time of war. (s)

I haven't had a chance to catch up on all the news but finding that we are now in Libya was also a little alarming.  So I will process, read and see what is happening in such a short period of time and then I will let you know if I am glad to be home or not.


Many of us also feel that she is committing Treason by slamming our President.  It is bad enough that she get's away with it in this Country but to do it in a foreign Country especially during a time of war is unacceptable!  Please write to the White House and tell them that we demand she be held accountable for her actions.

Update 3-23-2011 This article is getting a lot of attention on FB and Twitter and has been shared by many so I have also sent it to some of the media people at MSNBC.  We as a people need to start demanding that the Country as well as the media hold Palin responsible for her words and actions, especially if she insist on "raping her followers" of money under the guise of running for President.  I would also like to see SaraPac investigated in this as well.  My understanding,  the money can only be used for political reasons.  If that is the case then she has hung herself with using the funds for this trip as well as several statements she has made about meeting with Israel’s Prime Minister Benjamin Netanyahu to discuss political issues of Israel and our support for the Country.-Mem

Update: Why is this woman still allowed to talk and not behind bars?  A zoning issue?  Seriously Sarah is it brain freeze or what?  Just what the hell is wrong with you?  Were you born with out brain cells or did it happen over time?  Can we please do a citizens arrest on this Anti-American train wreck?

  1. NO one, other than the President should presume to speak for the USA ...with leaders of other countries unless the President has assigned that task to them.. ie Sec'y of State. Sarah Palin, in my opinion, should not speak for a nyone, as she has a hard time making sense speaking for her self and her family. And more often does harm. Dont need her meddling in foreign affairs.

  2. Wendy I agree with what you are saying about Sarah Palin as well as I find it very dangerous for our Country. This woman is all ABOUT invoking violence, fear and hate. She knows nothing about other Countries and obviously supported the AIP so she is not even a loyal American, let alone should be any type of spokes person for this Country. She is capable of causing great damage just by her words alone!

    Agree Mem, I feel based on how I understand the Law she is in violation. She probably does not know about the Law. If she did it would not have mattered she would just say, "Oh I did not know what it meant". We would all believe it because there is very little she does understand. Her heart is filled with spewing evil about President Obama and turning as many as possible against him. We see here now wanting to turn other Nations against him. In my book she is Extremely Dangerous to America and all Americans. Those on the right who believe the Rapture. Is going to come soon and Israel must achieve having Palestine out of the land before the rapture will happen.... I believe her trip to Israel is about this in a big way. DANGEROUS she is and I have no doubt she will make sure Israel will be told "O" is a Muslim and out to being Jihad on all of us and all christians... She is MORE THAN DANGEROUS- She like a 'SMAKE IN THE GRASS". Sorry I get started and cannot stop this woman makes my blood boil.

  7. As Palin understands anything no she is in no violation. Matter of fact if this government attempted to gag her we would step all over her (let her chose her own) amendment rights.
    However since we have more than fluff for brains we know that she is in violation but we also know that the government is in a precarious spot with her on this. Should they attempt to stop her she will play the victim, sexist card to the hilt and Obama will end up being the Big Black scary man loose in the neighborhood to rape all the women and children.
    What worries me is the misinformation she is giving. She cannot speak clearly, cannot form a complete sentence, makes no sense, lies through her teeth, has no credibility, and I bet my last dollar is over there pretending the represent herself as a spokesperson for the US. Some one should convince her to go into Libya, that only she could call The Big Q out and bring an end to his madness. I know she wouldn't last but a minute or two but hey....that's why I mentioned Libya to begin with:)

  8. One of the India newspapers online named her as an American policymaker, and I wrote right away to deny that she is anything but a private citizen. I agree that she IS in violation of this statute and should be arrested immediately. Please!

She can claim anything she wants but she has no right to speak for the citizens or the Country period!

  13. Treason against the king (President) was known as high treason and treason against a lesser superior was petit treason. A person who commits treason is known in law as a traitor.

    She went to another Country and slammed our President! This in itself should be a punishable crime! (I would be okay with hanging)

  14. When I first read that she was going on to Israel and meeting with the Prime Minister, I wondered how she could be allowed to do that? Because it is being given the air of a political meeting. I did not worry about her speaking to a group in India and I knew that she would probably misspeak at it as she did and she always does. I really hate that she slams President Obama at every chance and especially abroad. The Israel trip bothers me. Is she in violation of a law? Has she committed in essence treason? What can we do about it?

  18. Scorpie you are welcome and I agree with you. It is the one thing that made sense to me that describes what Palin is all about and a law that could actually define her. To me she is one of the most Anti-American people I have ever seen and does it under the guise of freedom and being a patriot... I have always seen her as an enemy of the lower 48 states. She does need to shut up and I would love to see the Feds meet her at the landing strip with some handcuffs!

  20. I most definitely agree that Palin is most likely in violation of the Logan Act but if the Attorney General were to attempt to prosecute her, it would bring far too much attention to her and give her more of that "victim status" that she loves to play up.

    Netanyahu is said to have an I.Q. in the range of 180. If he asks $arah any questions she will clearly be shown to be out of her league. Just as with the moderator who asked the questions during the Q&A session. He asked what she would have done differently. Her answer was more decisiveness, less dithering but she still didn't say what she would have actually done if in the same situation. In fact, she never does. Her standard talking points always revolve around "common sense conservatism", "free market principles", "private sector growth", "small government" and if she can throw in a word or two that mentions her patriotism, she'll add that to the equation. However, she NEVER answers anything as to what she would do differently.

    I would give anything to see her on Face the Nation, Meet the Press or any of the other weekend talk shows with a panel of real political analysts. Please someone ask her about quantitative easing, a question that can't be answered with one or two words and reveal that she has not a clue. She has Mansour doing all her writing for her and it is nothing like the way she speaks. Her vocabulary is very limited and she usually uses a word incorrectly when she tries anything new to her.

    The only reason Palin has built up the press as being the bad guys is so she can avoid them. She relies on them to write about her but whines if they say anything even slightly critical. She zeroes in on the critical part and then goes after the individual who wrote it just as she did when she was Governor and Mayor in Alaska. Let her go back to Alaska and leave the rest of us alone. Please!!!

Many of my friends on FB have written. So now we write the department of justice as well and keep writing until someone listens...

  22. Well said AKRNC. I wonder if she controls the questions in other Countries as she does here? What amazes me, that she gets away with it. If I were the media I would be hounding her and she would NOT get to pick the questions. You are so right though, she always has the same talking points, repeats what we have heard a thousand times and never has a solution. OYE!

  23. Well, it seems she somehow DOES control even the foreign media in so far that she simply refuses to answer any questions and slides out the backdoor whenever possible. Look at the example in India: After the first day, where she was caught going to the expensive mall, her handlers imposed an absolute media black-out (except the video-taped screech and follow-up questions). Then, in Israel, after she was caught turning back from the check point going into Bethlehem, she also ditched the media, and refused to answer any questions.
    She was in Israel during Purim, and had the 'Queen Esther' explained to her - Q.E. of all things, since that is actually what she is being called by her vapid followers...

  24. I also thought about the whole Queen Esther thing. Her sheeple will now believe that she is certainly the chosen one. What they don't seem to realize, God would choose someone with an IQ higher then 83 I think. Even God would want Sarah to know the difference between the red and the green button unless of course she is the one who has been chosen to "end" the world. That I can believe.

  25. I sent an e-mail to the depts/people listed below asking why Palin is allowed to speak agains the President of the US on foreign soil (no matter who is in office without suffering any fallout. In each e-mail I asked for a reply. Do't know if anyone will really reply. You know that if a Democrat did this the right-wingers, including the so-called MSM, would be in an uproar

    Later today I will also call my Senators and Representatives with the same questions.

    Many of us who support the Democratic Party have become disillusioned at the continued silence from Democratic leaders in the face of constants attacts by the republicans and the right-wing media against the President. And disillusioned at the continued silence from Democratic leaders when the so-called main stream media gives the republicans a pass.

    I believe that Palin should be prosecuted for treason under the Logan Act.

    Also, a formal complaint should be filed against the government of Israel for conducting meeting with Palin. She has no right to do this.

    Are we, as American citizens, allowed to file a complaint against Sarah Palin and against the government of Israel? How do we go about this? We as Americans should be able to do something about this. Just tell us how.

  28. Some people seem to think that it would be a good idea for Palin to run for President but I am NOT one of them. As I said to Joseph my friend on FB who wants to see Palin run! -I would NOT want to see Palin run for a number of reasons. #1 The independents and progressives might be mad at President Obama and stay home on election day or vote for a tea bagger. (that worked out so well for the country during the mid-terms) #2 George Bush was elected twice by idiots, cheating and the religious right. Palin has all of that including the money of the Koch brothers and other Corporations that GWB didn't have. #3 Palin NEVER pays for her wrong doings, always comes out smelling like a rose, the media loves a train wreck so she would be the main show and this Country seems to be full of morons that would put her in the WH!
